Welcome to Design Pexel, where creativity meets convenience. These Terms & Conditions govern your use of our design services and subscription plans. By accessing or using our website and services, you agree to abide by these terms. Please read them carefully.

1. Subscription Plans and Design Requests

1.1 Subscription Plans: Customers must purchase a monthly subscription plan to access our design services. Each subscription plan allows for unlimited design requests, with one request processed at a time.

1.2 Bonus Requests: Customers can purchase additional design requests at an extra charge if they require expedited service.

1.3 No Copywriting Included: Please note that copywriting services are not included in any of our subscription plans. If you want you have buy it separately.

1.4 Hosting & Domain: Hosting and domain services are not included in any of our subscription plans. Customers must purchase these services separately for web design projects.

1.5 Animated Ads: Animated ads are not included in the Design Essential and Design Pro subscription plans. Customers interested in animated ads must select a higher-tier plan or purchase them separately.

2. Use of Designs

2.1 Ownership: Upon completion and delivery of the designs, Design Pexel retains full ownership rights to the designs.

2.2 Portfolio Showcase: We reserve the right to showcase the designs created for you in our portfolio and marketing materials unless otherwise agreed upon.

3. Unlimited Revisions

3.1 Revision Policy: We offer unlimited revisions for each project until you are fully satisfied with the design. Your satisfaction is our priority, and we will work closely with you to ensure that your design meets your expectations.

4. Additional Terms

4.1 Service Restrictions: In the event of canceled subscriptions, access to our services will be restricted until a new subscription is purchased. But you can enjoy our services for which you had paid earlier till it expiry date. 

4.2 Modification of Terms: Design Pexel reserves the right to modify or update these Terms & Conditions at any time. Any changes will be effective immediately upon posting on our website.

5. Users of Paid Subscription Services. As part of a paid subscription, you may open a new project described by a unique project identification number provided by Us (“Project”). We reserve the right to close Projects where you have not provided feedback or confirmation of completion within fourteen (14) calendar days from delivery of any Service, regardless of whether or not the project is complete. Furthermore, We reserve the right to close a Project (except web design project) if it is still ongoing thirty (30) days after the User has received notice that the Project has commenced and has offered no feedback whatsoever to Design Pexel. Subject to the terms of the Service Agreement, We will provide reasonable support to start a new Project for any remaining work.

6. User Content Guidelines. We are not responsible for the accuracy or credibility of
any User Content and do not take any responsibility or assume any liability for
any actions you may take as a result of reading User Content posted on the
Websites. Through your use of Interactive Areas, you may be exposed to content
that you may find offensive, objectionable, harmful, inaccurate, or deceptive.
There may also be risks of dealing with underage persons, people acting under
false pretense, international trade issues, and/or foreign nationals. By using
Interactive Areas, you assume all associated risks.

7. Disclaimer of Warranty; Limitation of Liability.

(A) YOU EXPRESSLY AGREE THAT USE OF THE WEBSITES IS AT YOUR SOLE RISK. SUPERSIDE, ITS AFFILIATES, NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, CONTRACTORS, THIRD-PARTY CONTENT PROVIDERS, THIRD-PARTY SERVICE PROVIDERS OR LICENSORS DO NOT WARRANT THAT USE OF THE WEBSITES WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE WEBSITES, NOR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH THE WEBSITES.

(C) TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, IN NO EVENT SHALL SUPERSIDE, OR ITS FUTURE PARENT OR AFFILIATED COMPANIES, BE LIABLE TO YOU FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, COST OF SUBSTITUTE GOODS OR SERVICES, LOSS OF DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER AND/OR DEVICE OR TECHNOLOGY FAILURE OR MALFUNCTION OR FOR ANY FORM OF DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES BASED ON ANY CAUSES OF ACTION ARISING OUT OF USE OF THE WEBSITES OR ANY ALLEGED FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, OR DELAY IN SERVICE, OPERATION, OR TRANSMISSION OF THE WEBSITES, OR ANY ALLEGED COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OF PROPERTY, AND/OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF OR POSTING OF ANY RECORD, CONTENT, OR TECHNOLOGY, PERTAINING TO OR ON THE WEBSITES. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, YOU ALSO SPECIFICALLY ACKNOWLEDGE THAT SUPERSIDE OR FUTURE PARENT OR AFFILIATED COMPANIES ARE NOT LIABLE FOR ANY ACTUAL OR ALLEGED DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF USERS OF THE WEBSITES OR ANY THIRD PARTIES.

IF APPLICABLE LAW DOES NOT ALLOW ALL OR ANY PART OF THE ABOVE LIMITATION OF LIABILITY TO APPLY TO YOU, THE LIMITATIONS WILL APPLY TO YOU ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

 8. Termination. We may terminate or suspend these Terms at any time without notice to you. Without limiting the foregoing, We shall have the right to immediately terminate your access to the Websites in the event of any conduct by you which We, in our sole discretion, consider to be unacceptable, or in the event of any breach by you of these Terms. The provisions of Sections 2, and 5-11 shall survive termination of these Terms.
